上海首批共有产权保障房今满五年 交易细则出台【新民晚报·新民网】上海自2010年起开始供应共有产权保障住房,今年起,试点批次1800余户家庭已取得房地产权证逾五年,陆续符合上市交易的年限要求。为保证共有产权保障住房供后房屋交易和使用管理等工作的有序开展,作为《上海市共有产权保障住房管理办法》(市政府令第39号)实施文件的《上海市共有产权保障住房供后管理实施细则》(以下简称《实施细则》将于2016年9月30日开始实施。据介绍,《实施细则》主要规定了购房人购房后5年内回购、5年后政府优先购买、购买政府产权份额和上市转让的申请审核、办理程序、价格标准、税费承担等重点内容;同时,对于违规违约使用共有产权保障住房行为的发现、认定和分类处理等问题,也出台了相关政策措施。在交易方式方面,购房人、同住人取得房地产权证满5年,可以购买政府产权份额,也可以上市转让共有产权保障住房;上市转让共有产权保障住房的,区政府指定的住房保障机构在同等条件下有优先购买权,上市转让或者购买政府产权份额后,住房性质转变为商品住房。为加大对违规行为的制约力度,《实施细则》在交易方面实行“一票否决”,也就是说购房人、同住人拒不履行区房管部门作出的行政决定,以及有违规违约行为未改正等情形的,不得购买政府产权份额或者上市转让共有产权保障住房。在市民群众关心的交易价格方面,政府行使优先购买权以及购房人、同住人购买政府产权份额,按照房源项目市场基准价格执行。房源项目市场基准价格根据房源类型分别由市、区级住房保障机构委托房地产估价机构评估,参考房源项目相邻地段、相近品质商品住房价格等因素拟订,并经相关审批程序批准后适时公布。单套共有产权保障住房转让价格按照房源项目市场基准价格及其浮动幅度确定,浮动幅度与购买该套住房时使用的浮动幅度一致。共有产权保障住房是政府组织供应的保障性住房,为防止住房不再困难的对象继续占有共有产权保障住房,《实施细则》规定,取得房地产权证未满5年,购房人、同住人购买商品住房的,应当腾退共有产权保障住房,交区政府指定住房保障机构回购,回购价格为原购房款加同期银行存款利息;取得房地产权证满5年,购房人、同住人购买商品住房的,应当在商品住房转移登记前,先行上市转让共有产权保障住房或者购买政府产权份额。(新民晚报记者 杨玉红)相关链接:1、共有产权保障住房5年内回购有什么具体规定?购房人、同住人在提出申请后,取得房地产权证未满5年前,存在户口迁离本市或者出国定居、全部死亡以及购买商品住房(经区县住房保障机构核定仍符合住房困难面积标准除外)等情形之一的,其共有产权保障住房应当由区政府指定的机构予以回购;在此期间,购房人、同住人因夫妻离婚析产或者无法偿还购房贷款等原因,确需转让共有产权保障住房的,也可以向区住房保障机构申请政府回购。回购共有产权保障住房的,回购价款为原购房款加同期银行存款利息,计息周期为自原购房合同签订之日起至回购合同签订之日止。对回购申请、审核及实施的相关具体要求请查阅《实施细则》具体条款内容。2、共有产权保障住房5年后交易价格及计算方法?购房人取得房地产权证满5年后交易住房统一执行房源项目市场基准价格。房源项目市场基准价格,由住房保障实施机构委托具有相应资质和良好社会信誉的房地产估价机构评估,参考届时房源项目相邻地段、相近品质商品住房价格等因素,拟订住房基准价格和浮动幅度,报请同级房管部门组织发展改革、财政、地税、规土等部门共同审核,并报住房保障领导小组批准后公布。各类交易价格计算方法如下:政府指定机构优先购买的,交易双方以房源项目市场基准价格及其浮动幅度为基础,协商确定交易价格;购买政府产权份额的,按房源项目市场基准价格及其浮动幅度计算;上市转让的,按照上市转让价格及其浮动幅度计算,如上市交易价格低于房源项目市场基准价格的,按房源项目市场基准价格及其浮动幅度计算。3、对供后房屋违规违约使用行为如何处置?购房人、同住人应当按照房屋管理有关规定和供后房屋使用管理协议约定使用住房,在取得完全产权前严禁实施擅自转让、赠与、出租、出借共有产权保障住房或者设定除共有产权保障住房购房贷款担保以外的抵押权等行为。购房人、同住人实施上述行为,违反供后房屋使用管理协议约定的,房屋所在地区住房保障实施机构可以按照协议约定,要求其改正,并追究其违约责任。在行政责任方面,对于违规出租、出借的对象,由房屋所在地区县房管部门按照《上海市共有产权保障住房管理办法》的相关规定进行处理;对于改变房屋使用性质、损坏房屋承重结构、违章搭建等一般房屋使用违规行为,由房屋所在地区城管执法部门等按照国家和本市物业管理等相关规定进行处理。购房人、同住人违规使用房屋且逾期未改正的,房屋所在地区住房保障行政管理部门可以责令其腾退住房,并禁止5年内再次申请本市各类保障性住房。同时,对于存在因违规违约使用行为受到处理后又再次实施等严重违规情形的对象,区房管等部门可以将其违规违约行为情况和行政处理决定等信息,纳入市公共信用信息服务平台,供有关主体查询使用。管理部门提示:共有产权保障住房是政府组织供应的保障性住房,严禁房地产经纪机构和经纪人员违规代理共有产权保障住房出售(房地产权证未满五年)、出租、出借等业务。房地产经纪机构和经纪人员违规代理共有产权保障住房出售、出租、出借等业务的,由区房管部门责令限期改正,对房地产经纪人员处1万元罚款;对房地产经纪机构,取消网签备案资格,处3万元罚款。购房人、同住人将共有产权保障住房交由房地产经纪机构和经纪人员违规代理的,除将接受相关行政管理部门依法作出的处罚外,交易双方届时将面临无法办理交易过户(政府可行使优先购买权)的法律和道德风险,并承担相关合同违约责任。更多精彩内容欢迎搜索关注微信公众号:腾讯财经(financeapp)。相关的主题文章:
