河南拟禁小吃店网络外卖食品 吃麻辣烫外卖或成历史   □记者刘江浩   核心提示|足不出户,通过网络或者电话就能从小饭馆叫外卖,这样很方便,但也有人说存在一定的食品安全隐患。民生与安全,如何取舍?昨日,省政府法制办发布《河南省食品生产加工小作坊小餐饮和食品摊贩管理办法(修订草案征求意见稿)》(下称“办法”)。   小作坊:   指有固定生产加工场所,从业人员少,生产规模小,生产条件和工艺技术简单,从事食品生产加工活动的个体生产经营者。   小餐饮:   指有固定门店,经营规模小,从业人员少,条件简单,从事餐饮服务活动的小餐馆、小吃店、小饮品店等个体经营者。但是,加工经营面积在60平方米以上的,不适用本办法。   食品摊贩:指无固定店铺,在临时划定的地点和规定的时间内摆摊设点,从事食品销售或者提供餐饮服务的个体经营者。   谁来管?食药部门负责“三小”食品安全监管   去年以来,我省食品安全的监管体系进行重大变革,工商、质监不再负责食品安全流通和生产环节的监管,而这一职责,全部划入食品药品监督管理部门。办法规定,“三小”的监管,由食品药品监督管理部门负责。   不仅如此,办法还明确其他三部门职责。卫生行政部门负责“三小”食品安全风险监测和风险评估工作。城乡规划建设行政部门,负责本行政区域“三小”生产经营集中场所的规划、配套设施建设和管理。城市管理综合行政执法部门负责户外公共场所食品销售和餐饮摊点无证经营的查处工作。   我省食品小作坊、小餐饮和食品摊贩数量庞大。据统计,全省仅在册登记的小作坊就有5万多家;从事小餐馆、小吃店、小饮品店等小餐饮单位有4万多家,食品摊贩30万个左右。   怎么管?小作坊、小餐饮和小摊贩分别采取登记制、备案制   对于想经营“三小”者,如何才能入门?“为加强管理,经过反复研究,征求意见,决定对小作坊和小餐饮采取‘登记制度’。”省政府法制办相关人士说,食品摊贩实行备案制度,不需要申请工商登记。   “实施登记、备案不得收取费用。”上述人士介绍。记者还了解到,办法简化了登记程序,登记申请后进行资料审查,必要时可进行现场核查。如果食品小作坊向商场超市、集体食堂和大型餐饮服务企业销售生产的食品,应当提供登记证和食品检验合格证明文件。   在拿到“入场券”后,还有一些规范动作要完成。根据办法,食品生产加工小作坊、小餐饮应当在生产经营场所显著位置,悬挂或者张贴登记证、营业执照、从业人员健康证明,公示食品添加剂使用情况和食品安全承诺书等信息。食品摊贩应当在经营场所显著位置,悬挂或者张贴备案凭证、从业人员健康证明。   焦点1 食品摊贩不再仅由城管单方负责管理   一张桌子,两个炉灶,几把椅子,城市中,随处可见这样的食品摊贩。食品摊贩的监管涉及多个部门,药监、城管该谁上?   省政府法制办相关人士指出,我省此次规定摊贩向食品药品监管部门备案,户外公共场所食品销售和餐饮摊点无证经营由城管部门查处。   不过,省政府法制办相关人士还说,管理不再仅由城管单方负责,而是引入街道办、社区居委会、业主委员会、居民代表、职能部门等多方共同参与管理。   根据调研,我省一些地方乡镇政府、街道办多数不给食品摊贩办理“经营证明”,但作为食品药品监管部门的“备案”如何落实?省政府法制办相关人士说,经研究,保留乡镇政府及街道办事处办理的“经营证明”,将“办理”改为“出具”,作为到食品药品监管部门备案的前置条件。   焦点2 通过网络、微信、电话外卖食品不被允许   办法中有一条规定,与百姓生活颇为密切。第四十五条规定,禁止食品生产加工小作坊、小餐饮、食品摊贩通过网络、微信、电话等形式外卖食品。   当下,外卖风行,为百姓饮食提供极大便利。之所以有叫停“三小”网络或微信外卖的内容,根据食药部门的解释,是从公众食品安全的角度出发。“由于该办法只是在征求意见中,最终办法是否会有此内容,还要根据征求情况来定。”食药部门人士说。   不过,可以预见的是,一旦该条款内容被通过,对于小餐饮的经营收入,和老百姓的生活便利,将产生较大影响。   裱花蛋糕、散装酒、现制乳制品,都不许摊贩经营了   办法还规定有其他禁止性条款:   中小学校、幼儿园周边100米内不得规划、划定食品摊贩经营地点;   对已经规划的,规划地政府应当作出合理的安排。   食品摊贩不得经营裱花蛋糕、生食水产品、散装酒、现制乳制品、散装食醋、散装酱油、散装食用油以及国家、省规定禁止经营的其他食品。   处罚夜市摊销售变质食品可处5000元以下罚款   常吃夜市的人,可能最担忧的是饭菜是否干净卫生,食材是否过期变质?有了监管的主体和办法,违规的代价有多大呢?   根据办法,食品摊贩有下列行为之一的,由食品药品监督管理部门没收违法所得,没收不符合食品安全标准和要求的食品和食品原料,处500元以上5000元以下罚款;情节严重的,并处没收用于违法生产经营的工具、设备、原料等物品,责令停产停业;拒不改正的,由原备案部门注销备案证明,并向社会公告。   具体违规行为包括:销售霉变、腐败变质以及其他不符合食品安全标准和要求的食品的;用水不符合国家规定的生活饮用水卫生标准的;使用禁止使用的原料生产加工食品的。以及违反国家标准使用食品添加剂、使用超过保质期的食品添加剂,或添加食品添加剂以外的化学物质和其他可能危害人体健康的物质的。相关的主题文章:
